Terms of Sale

1.The Parties

"TCA," "we," "us," or "our" refers to Tamara Cook Analytics, LLC, the seller of the digital products on this website.

"You" or "Customer" refers to the individual or organization completing a purchase. If you're buying on behalf of an organization, you confirm you have authority to bind that organization to these terms.

2.What You're Buying

Our digital products are self-paced, asynchronous educational programs and templates delivered through an online portal. Specific deliverables vary by product but typically include:

• Written lessons and reference content accessible through your portal account
• Downloadable templates and supporting files (Excel, Word, PowerPoint, Power BI, and similar formats)
• Any additional materials described on the product's sales page at the time of purchase

Product descriptions on the sales page reflect what's included at the time you purchase. We may add to, improve, or update product content over time at our discretion. We are not obligated to deliver content beyond what is explicitly described on the sales page at the time of your purchase.

3.All Sales Are Final

This policy reflects the nature of digital goods: once you've completed checkout, you receive immediate access to the portal and the ability to download templates and view content. There is no way to "return" digital content once it has been accessed.

You should review the product sales page carefully before purchasing. If you have questions about whether a product is the right fit before buying, reach out through the contact form — we'd rather help you decide than have you regret a purchase.

This no-refund policy applies regardless of:

• Whether you have logged into the portal or downloaded any content
• Changes in your circumstances, schedule, role, or interests after purchase
• Your evaluation of the content's usefulness to your specific situation
• Time elapsed since purchase

Discretionary exceptions

In rare cases involving duplicate charges, technical errors that prevent access, or other extraordinary circumstances, we may issue a refund at our sole discretion. Discretionary refunds are not a right and are evaluated case-by-case.

4.Pricing, Payment, and Taxes

All prices are listed in U.S. dollars and are charged at the time of purchase. Payments are processed by Stripe, our third-party payment processor. We do not store your full payment card details on our servers.

Prices may change at any time, but a price change will not affect a purchase you've already completed. Promotional or "founding cohort" pricing is offered for limited periods; once a promotional window closes, standard pricing applies to subsequent purchases.

You are responsible for any sales tax, VAT, or similar taxes that may apply to your purchase based on your jurisdiction.

5.Account Access and Delivery

After a successful purchase, an account is created (or your existing account is updated) on our learning portal at learning-lab-portal.html. You'll receive a welcome email confirming access and explaining how to log in.

Ongoing access. You receive ongoing access to the content you purchased for as long as TCA continues to operate the Learning Lab. We make no guarantee that the Learning Lab will operate indefinitely, and we reserve the right to modify, discontinue, or sunset products at our discretion. If we sunset a product you've purchased, we will give reasonable notice and, where practical, make the downloadable templates and content available for export so you can retain your own copy.

Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

One account per purchase. Each purchase grants access to one user account. Sharing login credentials across multiple users or organizations violates these terms and may result in account termination without refund.

6.License and Use of Templates

Templates and downloadable files are provided under a limited, non-exclusive, non-transferable license for use by the purchaser (and, where the purchaser is an organization, the organization's employees and contractors).

You may:

• Use the templates internally within your organization for your own work
• Modify and adapt the templates to fit your specific use case
• Share your modified, populated versions with clients, colleagues, or stakeholders as part of your normal work product

You may not:

• Resell, redistribute, sublicense, or otherwise commercialize the templates as standalone products
• Share unmodified original templates publicly, post them in template libraries, or include them in trainings or courses you sell
• Remove, obscure, or alter copyright or attribution notices embedded in the files
• Use the templates or content to train machine learning models or build derivative AI products

7.Intellectual Property

All content in the Learning Lab — lessons, written materials, video walkthroughs, templates, branding, logos, and the portal interface itself — is the intellectual property of Tamara Cook Analytics, LLC, except for clearly identified third-party content used under license.

Your purchase grants you the access and usage rights described in Sections 5 and 6 above. It does not transfer ownership of any intellectual property to you.

8.Acceptable Use

You agree not to:

• Use the Learning Lab or any TCA digital product for any unlawful purpose
• Attempt to gain unauthorized access to the portal, other user accounts, or our backend systems
• Scrape, mass-download, or systematically extract content beyond normal personal use
• Misrepresent your affiliation with TCA or imply endorsement, certification, or partnership without written permission

Violations may result in immediate account termination without refund and, where applicable, legal action.

9.No Warranties

The Learning Lab and all digital products are provided "as is" and "as available." We do our best to produce accurate, useful, and high-quality content, but we make no warranty that:

• The content will meet your specific business requirements or produce particular outcomes
• The portal will be available without interruption or free of errors
• Templates will be compatible with every version of Microsoft 365, Power BI, or third-party software
• Implementation of the techniques taught will produce specific results in your environment

Educational content is exactly that — educational. It is not a substitute for professional consulting, legal advice, compliance review, or formal certification in any government or industry standard.

10.Limitation of Liability

To the maximum extent permitted by law, Tamara Cook Analytics, LLC's total liability to you for any claim arising out of or relating to a purchase, the Learning Lab, or these terms shall not exceed the amount you actually paid to TCA for the product giving rise to the claim.

TCA shall not be liable for any indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, business interruption, or reputational harm — even if advised of the possibility of such damages.

11.Chargebacks

If you initiate a chargeback or payment dispute with your card issuer or bank rather than contacting us directly, we reserve the right to:

• Suspend or terminate your portal access pending resolution
• Provide your purchase records, login activity, and these terms to the payment processor as evidence
• Decline future purchases from you

If you believe there's a problem with your purchase, please reach out through the contact form first — most issues can be resolved quickly without involving a third-party dispute.

12.Changes to These Terms

We may update these Terms of Sale from time to time. The version in effect at the time of your purchase governs that purchase. The current version is always posted at this URL with a current "Effective Date" at the top.

Material changes will be communicated to existing customers by email where practical.
